PREAMBLE
These Internal Regulations have been drawn up in accordance with the provisions of Articles L. 6352-3, L. 6352-4, L. 6352-5 and R. 6352-1 to R. 6352-15 of the Labour Code.
Their purpose is to determine:
– The main measures applicable to health and safety in the establishment
– The rules applicable to discipline, in particular the nature and scale of sanctions applicable to trainees and their rights
– The terms and conditions for the representation of trainees (for training courses of more than 500 hours)
Scope of application: These internal regulations apply to all trainees enrolled in training courses provided by ELE USAL Strasbourg, regardless of their status (employee, job seeker, student, private individual, etc.) and the training method (face-to-face, distance learning, hybrid).
Acceptance: The internal regulations are given to each trainee before their final enrolment. Signing the contract or training agreement constitutes full and complete acceptance of these regulations.

Important note: When the training takes place on the premises of a company or institution that already has internal regulations, the health and safety measures applicable to trainees are those of the host institution, in accordance with Article R. 6352-1 of the Labour Code.
ARTICLE 1 – IDENTIFICATION OF THE ORGANISATION

ARTICLE 2 – GENERAL PROVISIONS
2.1 Fundamental principles
ELE USAL Strasbourg undertakes to welcome all trainees with respect for their person, regardless of:
– Their origin, nationality, culture
– Their opinions, religious beliefs
– Their gender, sexual orientation
– Their age
– Their level of education or social situation
In return, each trainee is asked to observe the same behaviour of mutual respect towards trainers, administrative staff and other trainees.
2.2 Neutrality and secularism
In accordance with the principles of public service neutrality and educational values, trainees and trainers must refrain from any political, religious or ideological proselytism on the training premises.
2.3 Equality and non-discrimination
ELE USAL Strasbourg guarantees equal treatment for all trainees and is committed to combating all forms of discrimination and moral or sexual harassment, in accordance with Articles L. 1132-1 et seq. of the Labour Code.

ARTICLE 3 – HEALTH AND SAFETY
3.1 General obligations
Each trainee must ensure their own personal safety and that of other participants by complying with the general and specific instructions in force on the training premises.
3.2 Cleanliness of the premises
Trainees must help to keep the premises clean at all times.
Prohibitions:
– Eating in the classrooms (except in designated areas)
– Littering outside of the designated bins
– Damaging equipment, walls or furniture
3.3 Fire safety instructions
Mandatory display: Fire safety instructions, a map showing the location of fire extinguishers and emergency exits are displayed in a visible location on the premises.
Trainees’ obligations:
– Familiarise yourself with the evacuation instructions on the first day.
– Do not block emergency exits.
– In the event of an alarm, evacuate immediately and calmly according to the instructions given by the trainer or staff.
– Go to the designated assembly point.
Prohibition: Smoking is strictly prohibited in the training premises, in accordance with Decree No. 2006-1386 of 15 November 2006.
Use of safety equipment: It is prohibited to handle safety equipment (fire extinguishers, alarms) except in a real emergency.
3.4 Alcohol, drugs and prohibited substances
Strictly prohibited:
– Bringing alcoholic beverages onto the premises or consuming them on the premises
– Bringing narcotics onto the premises, consuming them or being under their influence
– Entering or remaining on the premises while intoxicated or under the influence of illegal substances
Penalty: Any breach of this prohibition will result in disciplinary action against the trainee, up to and including permanent exclusion without refund.
3.5 Accidents – Mandatory reporting
Any accident or incident occurring during training must be reported immediately by the injured trainee or witnesses:

An accident register is kept available for inspection by the labour inspectorate.
3.6 Materials and equipment
Trainees are responsible for the materials made available to them:
– Treat teaching and IT equipment with respect
– Do not move furniture without authorisation
– Report any damage or malfunction immediately
Liability: Any deliberate damage will result in the trainee being held civilly liable and may give rise to a claim for financial compensation.
ARTICLE 4 – DISCIPLINE AND TRAINING CONDITIONS
4.1 Attendance and punctuality
Attendance requirement: Attendance at all scheduled classes is mandatory. A minimum attendance rate of 80% is required in order to:
– Obtain the certificate of completion
– Validate CPF or OPCO funding
– Take the DELE/SIELE exams (for certified training courses)
Punctuality: Trainees undertake to respect the training schedule. Repeated and unjustified lateness may result in disciplinary action.
In case of late arrival:
– Notify the trainer or management immediately.
– Late arrivals of more than 15 minutes may result in refusal of access to the class in order to avoid disrupting the group.
4.2 Absence management
Mandatory notification: All absences must be reported before the start of the course by:

Justification: Absences must be justified within 48 hours by:
– Medical certificate
– Professional justification
– Any official document attesting to the reason for absence
Unjustified absences:
– No compensation or make-up classes
– No refund
– Risk of contract termination in the event of repeated absences (attendance rate < 80%)
Justified absences:
– Possibility of make-up classes depending on the trainer’s availability (not guaranteed)
– Postponement of sessions where possible
– No refund
4.3 Attendance sheets
Trainees must sign the attendance sheets at the start of each half-day of training (morning and afternoon) or each time they log in for remote training courses.
Important: These sheets constitute legal proof of attendance required by funding bodies (OPCO, Caisse des Dépôts CPF, etc.) and by the supervisory authorities.
Falsification: Any falsification of a signature constitutes serious misconduct and may result in permanent exclusion and legal proceedings.
4.4 Dress code and behaviour
Dress code: Appropriate and modest clothing is required. Clothing that may cause offence or discomfort is prohibited.
Expected behaviour:
– Respect trainers, staff and other trainees
– Do not disrupt the smooth running of classes
– Participate actively in educational activities
– Respect speaking times and the trainer’s instructions
– Adopt a constructive and caring attitude
Prohibitions:
– Aggressive, violent, abusive or disrespectful behaviour
– Moral or sexual harassment
– Discrimination in any form
– Use of mobile phones during classes (unless authorised by the trainer)
– Inappropriate use of computers or tablets for non-educational purposes
– Photographing/filming classes or people without prior authorisation
4.5 Personal work and assignments
Trainees undertake to:
– Complete the exercises and assignments requested between sessions
– Attend the assessments scheduled in the programme
– Actively prepare for classes (reading, revision)
– Meet the deadlines for submitting assignments
4.6 Use of digital tools
For online or hybrid training courses:
Required equipment:
– Stable internet connection
– Computer with working webcam and microphone
– Quiet environment conducive to learning
Rules of conduct:
– Log in at the scheduled time
– Turn on your camera (unless there are justified technical difficulties)
– Mute your microphone when you are not speaking
– Use the chat function in a respectful and relevant manner
Confidentiality: It is strictly forbidden to record, broadcast or share online courses without prior written authorisation from ELE USAL Strasbourg.
4.7 Intellectual property
All teaching materials (documents, presentations, exercises, videos) are the exclusive property of ELE USAL Strasbourg and the University of Salamanca.
Prohibitions:
– Reproducing, distributing or commercialising the materials
– Using the content for purposes other than personal use
– Transmitting the materials to third parties
Penalties: In accordance with Articles L. 335-2 et seq. of the Intellectual Property Code, any violation is subject to civil and criminal prosecution.
ARTICLE 5 – DISCIPLINARY SANCTIONS
5.1 Nature of sanctions
Any breach of these internal regulations may result in disciplinary action.
Scale of sanctions (in ascending order of severity):
- Verbal warning: Verbal reprimand by the trainer
- Written warning: Notification by email or post
- Written reprimand: Official notification recorded in the trainee’s file
- Temporary exclusion: Prohibition from attending one or more sessions (without refund)
- Permanent exclusion: Termination of the training contract without refund
5.2 Grounds for disciplinary action
Disciplinary action may be taken in the event of:
– Failure to comply with health and safety rules
– Repeated and unjustified absences
– Repeated tardiness
– Disruptive or disrespectful behaviour
– Physical or verbal violence
– Moral or sexual harassment
– Discrimination
– Drunkenness or use of narcotics
– Deliberate damage to equipment
– Falsification of documents (signing in, certificates)
– Theft
– Non-payment of training fees
– Any other serious breach of these provisions
5.3 Disciplinary procedure
For sanctions other than a verbal warning:
- Invitation to a meeting: The intern is invited to a meeting by registered letter with acknowledgement of receipt or email with acknowledgement of receipt, at least 5 working days before the date of the meeting.
- Preliminary interview: The intern may be assisted by a person of their choice (another intern, representative, etc.). They may present their observations and defence.
- Notification of the sanction: The reasoned decision is notified by registered letter with acknowledgement of receipt or email with acknowledgement of receipt, at least 2 working days and at most 1 month after the interview.
Exception – Serious misconduct: In the event of serious misconduct (violence, harassment, drunkenness), expulsion may be immediate as a precautionary measure, pending the preliminary interview.
5.4 Rights of the trainee
The trainee has the right to:
– Be informed in writing of the grievances against them
– Present their observations and defence during the interview
– Be assisted during the interview
– Challenge the sanction before the competent courts
Appeals: In the event of a dispute, the intern may refer the matter to:
– Consumer mediation (Art. L. 612-1 of the Consumer Code)
– The Labour Court (for employees)
– The competent civil courts
5.5 Limitation period
No previous penalty exceeding six months may be invoked in support of a new penalty.
ARTICLE 6 – REPRESENTATION OF TRAINEES
In accordance with Article L. 6352-4 of the Labour Code, for training courses lasting more than 500 hours in total, trainees shall elect full delegates and substitute delegates.
6.1 Election procedures
Voting rights and eligibility: All trainees are eligible to vote and stand for election, with the exception of:
– Prisoners admitted to a training course
– Trainees in individual training
Number of delegates:
– 1 full delegate and 1 substitute delegate for 4 to 25 trainees
– 2 full delegates and 2 substitute delegates for 26 to 100 trainees
– And so on for each additional 100 trainees
Voting: The election is held by single-member plurality voting during training hours, no later than 60 days after the start of the training course.
Organisation: The management of ELE USAL Strasbourg organises the voting and ensures that it runs smoothly.
6.2 Role of delegates
Delegates represent trainees in dealings with the training organisation for all matters relating to:
– General training conditions
– The organisation of training
– Health and safety
– The application of internal regulations
They may:
– Submit any suggestions, collective or individual complaints
– Refer any difficulties encountered to the management or trainers
6.3 Resources made available
Delegates shall be given the time necessary to perform their duties during training hours.
They shall be protected against any discriminatory measures on account of their mandate.
ARTICLE 7 – PROTECTION OF PERSONAL DATA
7.1 Data processing
In accordance with the GDPR (EU 2016/679) and the French Data Protection Act, ELE USAL Strasbourg collects and processes trainees’ personal data for the following purposes:
– Administrative and educational management
– Training monitoring and assessment
– Legal obligations (certificates, funding)

7.2 Trainees’ rights
Each trainee has the right to:
– Access, rectify and erase their data
– Object to and restrict the processing of their data
– Data portability

7.3 Image rights
Photographs or videos may be taken during training courses for communication purposes.
Consent: Obtained at the time of registration
Withdrawal: Possible at any time

ARTICLE 8 – ACCESSIBILITY AND DISABILITY
8.1 Commitment
ELE USAL Strasbourg is committed to welcoming people with disabilities and to implementing the necessary reasonable adjustments, in accordance with the law of 11 February 2005.

8.3 Requests for accommodation
Any trainee requiring accommodation must contact the disability advisor before registering in order to assess feasibility and put the necessary arrangements in place (equipment, pace, materials, assessment, etc.).
Partnerships: AGEFIPH, Cap Emploi, MDPH, specialised organisations.
Premises: Premises located on the 2nd floor without a lift. Direct access for people with reduced mobility is not possible; however, ELE USAL Strasbourg is implementing alternative solutions, including home-based or remote sessions.
ARTICLE 9 – COMPLAINTS
9.1 Procedure
In accordance with indicator 31 of the Qualiopi standard, any complaint relating to the conduct of the training course may be made:

Deadline: Within 30 days of the events
9.2 Processing
– Acknowledgement of receipt: Within 48 hours
– Internal investigation: Investigation and hearing of the parties
– Reasoned response: Within a maximum of 15 working days
– Traceability: Recording and follow-up for continuous improvement
9.3 Mediation
In the event of a persistent dispute, it is possible to resort to consumer mediation (Art. L. 612-1 of the Consumer Code).

ARTICLE 10 – FINAL PROVISIONS
10.1 Amendments to the rules
ELE USAL Strasbourg reserves the right to amend these internal rules at any time, in particular to comply with legislative or regulatory changes.
Communication: Trainees will be notified of any amendments by means of notices and publication on the website.
10.2 Consultation and display
These internal regulations are:
– Given to each trainee individually before enrolment
– Available for consultation at any time at www.strasbourg.eleusal.com
– Displayed in the training premises
– Available on request by email
10.3 Applicable law
These internal regulations are subject to French law, in particular:
– The Labour Code (Book III, Title V – Vocational Training)
– The Local Civil Code of Alsace-Moselle (Articles 21-79)
– The GDPR and the Data Protection Act
10.4 Competent jurisdiction
In the event of a dispute, after attempting to reach an amicable settlement, jurisdiction is given to the courts of Strasbourg.
ARTICLE 11 – ENTRY INTO FORCE
These internal regulations shall enter into force on 27 October 2025.
They shall apply to all trainees enrolled on or after that date.
