ARTICLE 2 – PURPOSE AND SCOPE

 

These General Terms of Sale (GTS) apply without restriction or reservation to all training services provided by ELE USAL Strasbourg, including:

 

– Spanish language training actions (all levels A1 to C2 according to CEFR)
– Preparation for DELE and SIELE certifications
– Corporate training and OPCO funding
– Individual, group and online courses
– CPF-eligible training (Personal Training Account)

 

Acceptance: Any registration for training implies full and unreserved acceptance of these GTS. In case of contradiction between these GTS and any other document, the GTS prevail.

 

Contractual documents: The training contract includes:

 

  1. These GTS

  2. The detailed training program

  3. The signed training contract or agreement

  4. The internal regulations

 

ARTICLE 3 – TRAINING SERVICES

 

3.1 Nature of services

 

ELE USAL Strasbourg offers Spanish as a foreign language training at all levels in various formats:

 

– Group courses: 3 to 8 participants maximum
– Individual courses: personalized support
– Online courses: synchronous sessions with live instructor
– Customized training: programs adapted to business needs
– Exam preparation: DELE and SIELE

 

3.2 Programs and pedagogical objectives

 

Each training includes:

 

– Clearly defined and measurable pedagogical objectives
– A detailed program adapted to CEFR level
– Action-oriented and communicative pedagogical methods
– Initial assessment (placement test)
– Continuous and final assessment of acquired skills
– Certificate of completion or diploma at end of training

 

3.3 Pedagogical and technical resources

 

– Native Spanish instructors with degrees and experience
– Provided teaching materials (except textbooks)
– Equipped classrooms at 9 rue Saint-Aloïse, 67100 Strasbourg
– Digital tools (Zoom, Teams depending on training)

 

3.4 Access conditions and prerequisites

 

Minimum age: 16 years (parental authorization required for minors aged 16 to 18)
Mandatory placement test: Free written and oral assessment (except complete beginners)
Registration deadline: Up to 11 working days before training start (7 days for CPF training)
Response time: 48 hours maximum after receiving your request
PMR accessibility: Premises located on 2nd floor without elevator. Direct access for persons with reduced mobility is not possible; however, ELE USAL Strasbourg implements alternative solutions, such as home-based or online sessions, to ensure equitable access to training and compensate for disabilities.

 

ARTICLE 4 – PRICING CONDITIONS

 

4.1 Rates

 

Rates are expressed in euros including VAT and include:

 

– Teaching fees
– Association membership fee (€20 per academic year)
– Placement test
– Digital teaching materials
– Certificate of completion

 

Not included:

 

– Textbooks (communicated at registration, approximately €20-30)
– Official DELE/SIELE exam registration fees (Instituto Cervantes rates)
– Possible travel for home courses

 

4.2 Preferential rates

 

– Former students: €100 discount on standard rate
– Students: €250 discount upon presentation of valid proof

 

4.3 Financing

 

CPF (Personal Training Account):

 

– Certifying training courses necessarily with DELE exam
– Registration via Mon Compte Formation
– Waiting period of 11 working days before training start

 

Individuals:

 

– Cash or installment payment (50% at registration, balance before start)
– Accepted methods: bank transfer, check, cash (max €1000)

 

4.4 Payment terms

 

Schedule:

 

– 1st payment: 50% minimum at registration
– Balance: at latest 7 days before training start

 

Late payment:

 

– Suspension of course access in case of non-payment
– Late payment penalties: 3 times the legal interest rate
– Flat-rate compensation for recovery costs: €40

 

ARTICLE 5 – REGISTRATION PROCEDURES

 

5.1 Registration procedure

 

  1. Information request: by email, phone or web form

  2. Placement test: free and mandatory (except beginners)

  3. Pedagogical interview: definition of objectives and pathway

  4. Personalized quote: sent within 48h

  5. Training contract: electronic or paper signature

  6. Payment: according to agreed terms

  7. Summons: sent 7 days before training start

 

5.2 Documents to provide

 

– Identity document (copy)
– Parental authorization for minors
– Student or job seeker proof (if discount)
– RQTH notification (if adaptation needed)

 

5.3 Group formation

 

Minimum number: 3 participants to maintain a group.

 

In case of insufficient numbers, ELE USAL reserves the right to:

 

– Postpone the course to a later session (notification 7 days before)
– Offer an individual course with adapted hours (proportional reduction)
– Fully refund amounts paid

 

Maximum number: 8 participants to guarantee pedagogical quality.

 

ARTICLE 6 – CANCELLATION, POSTPONEMENT AND WITHDRAWAL

 

6.1 Right of withdrawal (non-CPF training)

 

In accordance with article L. 221-18 of the Consumer Code, you have 14 days to exercise your right of withdrawal without having to justify reasons or pay penalties.

 

Starting point: From contract signature
Procedures: Notification by email or registered mail
Refund: Within 14 days following withdrawal notification
Exception: If training has started during the withdrawal period with your express agreement, you must pay pro rata for hours completed.

 

6.2 Cancellation by trainee (outside withdrawal period)

 

More than 30 days before start:

– Full refund minus administrative fees (€50)

 

Between 15 and 30 days before:

– 30% withholding of total amount

 

Between 8 and 14 days before:

– 50% withholding of total amount

 

Less than 7 days before:

– No refund (except force majeure)

 

After training start:

– No refund except duly justified force majeure (medical certificate, dismissal, unforeseeable professional transfer)

 

6.3 Cancellation or postponement by organization

 

In case of cancellation by ELE USAL Strasbourg (unavailable trainer, insufficient numbers, force majeure):

 

– Notification: At least 7 working days before scheduled start
– Options offered:
– Training postponement to later date without additional fees
– Full refund of amounts paid within 30 days

 

Limited liability: ELE USAL cannot be held responsible for costs incurred by trainee (transport, accommodation) in case of cancellation.

 

6.4 Force majeure

 

Considered as force majeure justifying cancellation or interruption without penalties:

 

– Serious illness or accident with medical certificate
– Death of close relative (spouse, parent, child)
– Economic dismissal
– Unforeseeable and mandatory professional transfer
– Exceptional event independent of parties’ will (natural disaster, epidemic, etc.)

 

Mandatory supporting documents: Official documents to be provided within 7 days

 

ARTICLE 7 – OBLIGATIONS OF THE PARTIES

 

7.1 ELE USAL Strasbourg obligations

 

– Provide training according to announced program
– Make available qualified and experienced trainers
– Provide digital teaching materials
– Ensure individual and collective pedagogical monitoring
– Issue monthly attendance certificates
– Issue certificate of completion at end of training
– Respect confidentiality of personal data (GDPR)
– Maintain Qualiopi certification

 

7.2 Trainee obligations

 

– Respect schedules and required attendance
– Have requested equipment (textbook, computer if online course)
– Respect organization’s internal regulations
– Pay training fees within agreed deadlines
– Report any absence in advance by email or phone
– Actively engage in training pathway
– Treat trainers, staff and other learners with respect
– Complete requested evaluations (placement, satisfaction, achievements)

 

ARTICLE 8 – ATTENDANCE AND ABSENTEEISM

 

8.1 Attendance obligation

 

Attendance is mandatory at all scheduled courses.

 

Minimum attendance rate required: 80% to:

 

– Obtain certificate of completion
– Validate CPF or OPCO funding
– Benefit from evaluations and pedagogical progression

 

8.2 Absence management

 

Justified absences (medical certificate, imperative professional obligations):

 

– Possibility of make-up according to trainer availability
– Session postponement when possible
– No refund

 

Unjustified absences:

 

– No compensation or make-up
– No refund
– Risk of contract termination in case of repeated absences

Repeated delays: May result in exclusion from current course to avoid disrupting the group.

 

ARTICLE 9 – EVALUATION AND CERTIFICATION

 

9.1 Evaluation procedures

 

Initial evaluation:

 

– Free written and oral placement test
– Level determination according to CEFR (A1 to C2)

 

Continuous evaluation:

 

– Regular formative exercises
– Class participation
– Personal work

 

Final evaluation:

 

– Level test at end of training
– Measurement of progress achieved

 

9.2 Certifications and certificates

 

Certificate of completion:

 

– Issued at end of training (80% minimum attendance)
– Compliant with training organization regulations
– Mentions: objectives, nature, duration, results achieved

 

ELE USAL Diploma:

 

– Internal certification from University of Salamanca
– Upon request and according to conditions

 

Official DELE/SIELE certifications:

 

– Preparation provided in our certifying training courses
– Registration and exam: Instituto Cervantes sessions
– Additional exam fees (between €100 and €220 depending on level)
– CPF training: DELE exam mandatory and included in pathway

 

ARTICLE 10 – COMPLAINTS AND MEDIATION

 

10.1 Complaint procedure

 

In accordance with indicator 31 of the Qualiopi framework, any complaint must be made:

Deadline: Within 30 days following the facts

 

Processing:

 

– Acknowledgment of receipt within 48 hours
– Internal analysis and investigation
– Reasoned response within maximum 15 working days
– Traceability and follow-up for continuous improvement

 

10.2 Consumer mediation

 

In accordance with article L. 612-1 of the Consumer Code, in case of persistent disagreement after written complaint, you may use a consumer mediator free of charge:

ARTICLE 11 – DISABILITY ACCESSIBILITY

 

ELE USAL Strasbourg is committed to universal accessibility in accordance with the law of February 11, 2005:

ARTICLE 12 – PERSONAL DATA PROTECTION

 

12.1 GDPR compliance

 

Collected personal data is subject to computer processing in accordance with GDPR (EU 2016/679) and French Data Protection Act.

 

Purposes:

 

– Administrative and pedagogical management
– Billing and payment monitoring
– Communication about our training courses

12.2 Individual rights

 

You have the right to access, rectify, erase, object, limit and port data concerning you.

ARTICLE 13 – INTELLECTUAL PROPERTY

 

All teaching materials, methods, content and documents remain the exclusive property of:

 

– ELE USAL Strasbourg
– University of Salamanca (USAL)
– Their respective authors

 

Prohibitions:

 

– Any reproduction, distribution, commercialization
– Any use for purposes other than personal
– Without prior written authorization

 

Sanctions: In accordance with articles L. 335-2 and following of the Intellectual Property Code.

 

ARTICLE 14 – LIABILITY AND INSURANCE

 

14.1 Organization liability

 

ELE USAL Strasbourg’s liability is limited to direct damages resulting from non-performance of its contractual obligations.

 

Excluded: Indirect damages, loss of opportunity, loss of profit, commercial harm.

 

14.2 Trainee liability

 

The trainee is responsible for:

 

– Personal belongings during training
– Damage they may cause to premises or equipment
– Travel and safety outside training

 

14.3 Insurance

 

ELE USAL Strasbourg subscribes to necessary insurance covering:

 

– Professional civil liability
– Premises and equipment
– Trainers’ civil liability

 

Trainee insurance: Trainees are recommended to verify their civil liability insurance coverage.

 

ARTICLE 15 – INTERNAL REGULATIONS

 

Internal regulations specify:

 

– General operating rules
– Discipline and safety rules
– Applicable disciplinary sanctions

 

Communication:

 

– Given to each trainee before training start
– Available on our website
– Acceptance mandatory

 

ARTICLE 16 – EXCLUSION AND TERMINATION

 

16.1 Grounds for exclusion

 

ELE USAL reserves the right to exclude a trainee for:

 

– Non-compliance with internal regulations
– Disruptive or disrespectful behavior
– Repeated and unjustified absences (rate < 80%)
– Non-payment of training fees
– Serious breach of contractual obligations

 

16.2 Procedure

 

– Prior written warning (except serious misconduct)
– Interview with management
– Exclusion notification by registered mail with acknowledgment of receipt

 

16.3 Consequences

 

– Immediate contract termination
– No refund of amounts paid
– Billing of hours already completed if installment payment

 

ARTICLE 17 – MODIFICATION OF GTS

 

ELE USAL Strasbourg reserves the right to modify these GTS at any time.

 

Application: New conditions apply to contracts concluded after their publication on our website.

 

Current contracts: Remain subject to GTS accepted at registration except imperative legal modification.

 

ARTICLE 18 – APPLICABLE LAW AND JURISDICTION

 

18.1 Applicable law

 

These GTS are subject to French law and in particular:

 

– Local Civil Code of Alsace-Moselle (articles 21 to 79) for associative status
– Labor Code (Book III, Title III) for professional training
– Consumer Code for relations with individuals
– GDPR and Data Protection Act

 

18.2 Contract language

 

The contract language is French.

 

18.3 Jurisdiction

 

Mandatory attempt at amicable settlement: Consumer mediation

 

In case of failure and dispute, exclusive jurisdiction of Strasbourg courts, notwithstanding plurality of defendants or third-party notice.
