Article 1 – Identification of the Organization

Article 2 – Purpose and Scope of Application

These General Terms and Conditions of Sale (GTC) apply without restriction or reservation to all training services provided by ELE USAL Strasbourg, including:

  • Spanish language training courses (levels A1 to C2 according to the CEFR).
  • Preparation for DELE and SIELE certifications.
  • Corporate training and OPCO-funded programs.
  • Private, group, and online classes.
  • Training eligible for the CPF (Compte Personnel de Formation).

Acceptance: Any registration implies full and unreserved acceptance of these GTC. In the event of a contradiction with any other internal document, these GTC shall prevail.

CPF Exception: For registrations made via Mon Compte Formation, the General Terms of Use (CGU) of the Caisse des Dépôts systematically prevail over these GTC in the event of a dispute.

Contractual Documents: The contract includes these GTC, the detailed training program, the signed contract/agreement, and the internal regulations.

Article 3 – Training Services

3.1 Nature of Services

We offer group classes (3 to 8 participants), individual lessons, online courses (synchronous sessions), customized programs for companies, and DELE/SIELE exam preparation.

3.2 Programs and Objectives

Each training includes measurable objectives, a program adapted to the CEFR, action-oriented methods, initial, continuous, and final evaluations, as well as a certificate of completion.

3.3 Pedagogical Resources

Qualified native Spanish trainers, provided materials (excluding textbooks), equipped classrooms, and digital tools (Zoom, Teams).

3.4 Access Modalities

Minimum age: 16 years old (parental authorization required for minors).
Placement test: Mandatory and free (except for complete beginners).
Registration deadline: Up to 11 working days before the start (including for CPF, where this delay is a strict legal requirement).
Response time: Maximum 48 hours after receiving your request.

Article 4 – Pricing Conditions

4.1 Rates

Prices are indicated in euros, net of tax (VAT not applicable, art. 261-4-4° a of the French Tax Code – CGI). They include: tuition fees, annual membership (20€/year), placement test, digital materials, and a certificate of completion. Not included: Textbooks (20-30€), DELE/SIELE exam fees, and travel expenses for home tutoring.

4.2 Preferential Rates

  • Former students: 100€ discount on the standard rate.
  • Students: 250€ discount upon presentation of a valid student ID.

4.3 CPF Funding (2026 Update)

  • Mandatory contribution: A financial participation of 150 € is required from the trainee (effective since April 2, 2026).
  • Authentication: Registration is strictly carried out via Mon Compte Formation using FranceConnect+.
  • Certification: Taking the DELE exam is mandatory at the end of the course.
  • Cap: Funding is capped at 1,500 € for registered certifications (RS).

4.4 Payment Methods (Individuals)

Full or installment payments (minimum 50% deposit upon registration, balance due 7 days before the start). In case of late payment: suspension of access, late penalties of 3 times the legal interest rate, and a 40€ flat fee for recovery costs.

Article 5 – Registration Modalities

5.1 Procedure: 1. Information request | 2. Placement test | 3. Pedagogical interview | 4. Quote (within 48h) | 5. Signed contract | 6. Payment | 7. Convocation (7 days prior).

5.2 Required Documents: ID copy, parental authorization (minors), student/job seeker proof (if applicable), RQTH notification (if adaptations are needed).

5.3 Group Formation: Minimum of 3 and maximum of 8 participants. If the minimum is not reached, ELE USAL may postpone the course, offer individual lessons with an adapted hourly volume, or provide a full refund.

Article 6 – Cancellation, Postponement, and Withdrawal

6.1 Right of Withdrawal (excluding CPF): Legal cooling-off period of 14 clear days to cancel without providing a reason (Art. L. 221-18 of the French Consumer Code). Refund within 14 days. If the course has started with your consent, billing will be prorated.

6.2 Cancellation by the Trainee:
– More than 30 days before: Full refund minus a 50€ administrative fee.
– 15 to 30 days before: 30% of the total amount retained.
– 8 to 14 days before: 50% of the total amount retained.
– Less than 7 days or after start: No refund (unless justified force majeure within 7 days).

6.3 Cancellation by the Organization: Notification 7 days prior. Offer of postponement or full refund within 30 days. ELE USAL is not liable for ancillary expenses incurred by the trainee.

6.4 Force Majeure: Serious illness, death of a close relative, economic dismissal, unforeseeable relocation (official proof required).

Article 7 – Obligations of the Parties

ELE USAL commits to: Deliver the program, provide qualified trainers, ensure follow-up, issue certificates, comply with GDPR, and maintain Qualiopi certification.

The Trainee commits to: Respect schedules, bring required materials, pay training fees, notify absences in advance, actively participate, comply with internal regulations, and complete required evaluations.

Article 8 – Attendance and Absenteeism

Attendance is mandatory. A minimum attendance rate of 80% is required to obtain the certificate or validate CPF/OPCO funding.

Justified absences: Make-up sessions possible depending on availability (no refunds).
Unjustified absences: No compensation, risk of contract termination.
Notification: Mandatory before the class via email or phone (+33 6 67 53 77 41).

Article 9 – Evaluation and Certification

Initial, continuous, and final evaluations are conducted to measure progress.

Certifications:
– Certificate of completion: Issued at the end of the course (if 80% attendance is met).
– ELE USAL Diploma: Internal certification from the University of Salamanca (upon request).
– Official certifications: DELE/SIELE examination center. Exam fees are extra (100€ to 220€). Taking the DELE is mandatory for CPF-funded courses.

Article 10 – Complaints and Disputes

Complaints (Qualiopi Ind. 31): Any complaint must be made in writing within 30 days of the events. You can send it to us:

An acknowledgment of receipt will be sent within 48 hours, and a reasoned response within a maximum of 15 working days, aiming for continuous improvement.

Dispute Resolution: In the event of a persistent dispute and after having submitted a written complaint that remained unsuccessful, the consumer is informed that they may resort to a conventional mediation procedure or any other alternative dispute resolution method.

Furthermore, in accordance with EU Regulation No. 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr/.

Article 11 – Disability Accessibility

Disability Referent: Mrs. Diana BRAVO MORENO (dbravom@strasbourg-eleusal.com). Prior contact is mandatory to adapt the learning path.

The premises (2nd floor without an elevator) do not allow direct access for persons with reduced mobility. However, ELE USAL Strasbourg systematically implements alternative solutions (home tutoring or remote sessions) to ensure equitable access to training.

Article 12 – Personal Data Protection

Data is processed in compliance with the GDPR for administrative management. You have the right to access, rectify, and erase your data via info@strasbourg-eleusal.com (response within 1 month). Complaints: cnil.fr.

Image Rights: Photos/videos may be taken. Consent is requested upon registration and can be withdrawn at any time.

Article 13 – Intellectual Property

All materials remain the exclusive property of ELE USAL Strasbourg and/or the University of Salamanca. Any reproduction or distribution is strictly prohibited without written permission (Art. L. 335-2 of the French Intellectual Property Code).

Article 14 – Liability and Insurance

ELE USAL’s liability is limited to direct damages. The trainee is responsible for their personal belongings and any damages caused to the premises. ELE USAL is covered by professional civil liability insurance; trainees are advised to verify their own civil liability coverage.

Article 15 – Internal Regulations

Provided to each trainee and available on the website, it specifies the operating, safety, and disciplinary rules. Its acceptance is mandatory.

Article 16 – Exclusion and Termination

Grounds: Non-compliance with regulations, disrespectful behavior, repeated absences, non-payment. Procedure: Warning, interview, notification by registered mail with acknowledgment of receipt. Consequences: Immediate termination without refund.

Article 17 – Modification of the GTC

ELE USAL Strasbourg reserves the right to modify the GTC. New conditions apply to contracts signed after publication. Ongoing contracts remain subject to the GTC accepted at the time of registration.

Article 18 – Applicable Law and Jurisdiction

Governed by French law (Alsace-Moselle local civil code, Labor Code, Consumer Code). Contract Language: French (these translated GTC are for informational purposes). In the event of a dispute and failure of mediation, exclusive jurisdiction is granted to the courts of Strasbourg.
